Wea Terms of Service

Service: Wea mobile application and related services (collectively, the “Service”)

By downloading, accessing, or using the Service, you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Service.
1) Key points (read this)
- Road rules win. Information in the Service does not replace road signs, parking restrictions, time-based rules, or instructions from authorities.
- Safety first. Do not interact with the Service while driving in a way that violates the law or distracts you. Submit reports/offers only when safely stopped or by a passenger.
- Community data changes fast. Reports and offers are user-generated and may be inaccurate, outdated, incomplete, or unavailable.
- Coordination platform. Wea helps users coordinate parking-related information and private-spot sharing. Wea does not sell public parking spots.
- Wea Points are earned. Wea Points are earned through participation and are not purchased with money.
2) What Wea provides
Wea is a community-driven platform that may include:
- Public spot activity signals (e.g., occupancy indicators),
- User reports (e.g., availability, conditions),
- “Switch Offers” that enable coordination between a user leaving a spot (“Leaver”) and a user seeking a spot (“Seeker”),
- Private spot coordination where users may share their own private parking spaces and allow time-based reservations/coordination.
We may add, change, or remove features at any time.
3) Eligibility / age
You must be at least 16 years old (or the minimum legal age required in your country) to use the Service. You are responsible for complying with all laws applicable to driving and parking, including any requirements related to holding a driving license.
4) Accounts and responsibility
To use certain features you may need an account. You agree to:
- Provide accurate information where required,
- Keep your login credentials secure,
- Be responsible for all activity under your account.
We may suspend or terminate accounts as described in these Terms.
5) Location-based features
Many features require location access. If you disable location permission, parts of the Service may not work. Your use of location data is described in our Privacy Policy.
6) Safety and driving rules
You agree that you will not use the Service in a manner that violates traffic laws or is unsafe. In particular, you agree not to create reports/offers or otherwise interact with the Service while driving if doing so is illegal or distracting.
Wea is not responsible for incidents arising from unsafe use of the Service.
7) Parking legality and compliance
You are solely responsible for:
- Where and how you park,
- Compliance with local parking rules (including permits, time limits, loading zones, resident-only zones, paid parking requirements, and towing rules),
- Ensuring you have the right to list/share a private parking space (ownership/permission, building rules, landlord/tenant rules, HOA rules, etc.).
Wea does not guarantee that any spot is legal, available, or safe.
8) Wea Points, XP, levels, and rewards
- Wea Points and XP are in-app features used to support participation and coordination.
- Wea Points are earned only through actions in the Service (e.g., reporting, sharing a private spot, offering switches, or other community actions defined in the app).
- We may adjust earning rules, balances, tiers, badges, leaderboards, or eligibility at any time to prevent abuse and improve fairness.
- We may remove Wea Points/XP or reverse activity if we reasonably believe there is fraud, abuse, manipulation, or violations of these Terms.

The Service may allow you to post content such as reports, offers, descriptions, images, messages/comments (if enabled), and other information (“User Content”).

11) License to use the Service
We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for your personal, non-commercial use, subject to these Terms.
12) Restrictions (what you can’t do)
You may not:
- Reverse engineer, decompile, or attempt to extract the source code (except where allowed by law),
- Scrape, harvest, or data-mine the Service,
- Copy, export, republish, or commercially exploit Service data/content except as intended through the app,
- Use the Service to operate a competing service or for commercial resale without our written consent,
- Circumvent security or access controls, or interfere with normal operation.
13) Your content license to Wea
By submitting User Content, you grant Wea a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify (for formatting/display), distribute, and display that content to:
- operate and improve the Service,
- maintain safety and integrity,
- enforce these Terms.
You represent that you have the rights to submit the content and that it does not violate any law or third-party rights.
14) Third-party services
The Service may rely on third-party services (e.g., hosting, maps, notifications, app stores). We are not responsible for third-party services or outages beyond our control.
15) Disclaimers
THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- We do not guarantee accuracy, reliability, completeness, legality, or timeliness of reports, offers, occupancy indicators, maps, or availability.
- We do not guarantee that you will find parking.
- We do not guarantee uninterrupted, error-free operation.
Community-based information can be wrong. Use judgment and follow road signs and laws.
16) No insurance; vehicle/property responsibility
Wea does not provide insurance for vehicles, property, or personal injury. You are responsible for your own insurance coverage and for any risks associated with parking and coordinating with other users.
17) Limitation of liability
To the maximum extent permitted by law, Wea and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or business interruption, arising out of or related to:
- Your use of or inability to use the Service,
- Your reliance on community content,
- Parking availability, legality, enforcement actions (tickets/towing), theft, damage, disputes, or personal injury,
- Interactions between users.
Where liability cannot be excluded, it will be limited to the minimum amount permitted by applicable law.
18) Indemnity
You agree to indemnify and hold harmless Wea from claims, damages, losses, and expenses (including reasonable legal fees) arising from:
- Your use of the Service,
- Your User Content,
- Your violation of these Terms or applicable laws,
- Your interactions with other users.
19) Termination
You may stop using the Service at any time. We may suspend or terminate your access if:
- You violate these Terms,
- We reasonably believe your actions harm users, the Service, or third parties,
- We must comply with legal requirements.
You can request account deletion via the app (Settings → Privacy & Security) or by contacting support, subject to our Privacy Policy and legal retention obligations.
20) Changes to the Service and Terms
We may update the Service and these Terms from time to time. If changes are material, we may provide notice in the app or by other reasonable means. Continued use after an update means you accept the updated Terms.
21) Governing law and jurisdiction
These Terms are governed by the laws of the Republic of Croatia. Any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be subject to the jurisdiction of the competent courts in Zagreb, Croatia, unless mandatory consumer protection laws require otherwise.
